NHTSA Says It Cannot Regulate Truck Engines Separately. What Fleets Should Know
Federal fuel-efficiency standards for heavy-duty truck engines are headed for a rewrite. On August 31, 2026, the National Highway Traffic Safety Administration (NHTSA) published an interpretive rule in the Federal Register concluding that Congress never gave it authority to regulate truck engines separately from complete vehicles. Existing standards stay on the books for now, but the legal foundation is set for removing the engine-only layer of the rules. For fleets and the aftermarket, nothing changes on trucks being ordered today, yet the compliance framework around future diesel powertrains has become less predictable.
What happened
In the August 31 notice (Docket No. NHTSA-2026-1948), NHTSA stated that the Energy Independence and Security Act of 2007 requires it to set fuel economy standards for commercial medium- and heavy-duty on-highway vehicles and work trucks, but did not authorize separate standards for engines as standalone components. "An engine is not a vehicle," the agency wrote, reasoning that the power to regulate a vehicle does not automatically include the power to regulate each of its components, such as tires or transmissions, separately.
The agency pointed to two legal developments behind its shift: a 2021 federal appeals court decision that struck down NHTSA's fuel-efficiency standards for trailers, and the Supreme Court's 2024 Loper Bright ruling, which ended courts' practice of deferring to agencies' interpretations of ambiguous statutes.
Equally important is what the notice does not do. NHTSA stressed that the interpretive rule "does not change existing standards or any rights or obligations" under the medium- and heavy-duty program. The current Phase 2 standards, including requirements covering model-year 2027 and later trucks and engines, remain in the regulations. What comes next is a full notice-and-comment rulemaking to revise the program, and NHTSA said it will exercise enforcement in line with its new interpretation while that process runs.

Why NHTSA is doing this
The move is one more piece of a broader reset of federal truck efficiency regulation. Earlier this year, EPA rescinded its heavy-duty greenhouse-gas standards, unwinding rules that NHTSA and EPA had historically developed together. NHTSA also said it is reviewing how the NOx reductions required by EPA's 2027 standards interact with fuel consumption, since cutting NOx can involve combustion and aftertreatment strategies that burn additional fuel. The Truck and Engine Manufacturers Association welcomed the review, arguing that the current unmodified standards would considerably restrict the equipment choices fleets can specify, and calling for replacement standards that reflect how fleets actually adopt fuel-saving technology.
What it means for fleets and the aftermarket
- No immediate change to 2027 truck orders. The engines and trucks built for EPA's 2027 NOx requirements are still coming. Fleets finalizing 2027 purchases should plan around the equipment that exists today, not around rules that may change later.
- More paths to compliance may open up. Under a vehicle-only approach, manufacturers could meet fuel-efficiency targets through aerodynamics, transmissions, axle ratios, tires, and idle-reduction technology, not just engine hardware. That could widen the spec choices available to buyers.
- Spec uncertainty cuts both ways. If engine standards are removed, efficiency gains will depend more on how the whole truck is specified and maintained. Real-world fuel economy will lean harder on correct gearing, calibration, and component condition.
- Longer service lives raise the stakes for parts quality. Whatever happens to the rules, the existing fleet keeps running. With the average age of trucks on the road already high, keeping aging diesel powertrains efficient depends on components such as turbochargers working to specification.
